Welcome to Beach Bum Vacations (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of our website, services, and related offerings. By accessing or using our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.

1. Legal Status and Governing Body

1.1 Business Location and Regulation:

Beach Bum Vacations is legally established in Ontario, Canada, and is subject to the regulations and guidelines set forth by the Travel Industry Council of Ontario (“TICO”). All travel-related transactions, operations, and dispute resolutions adhere to TICO standards.

1.2 Governing Law:

These Terms and any related disputes shall be governed by the laws of the Province of Ontario and the applicable laws of Canada. Any unresolved disputes may be escalated through our host agency, Nexion Canada, and ultimately may be addressed through TICO’s dispute resolution process.

2. Services Offered

2.1 Travel Arrangements:

We facilitate travel bookings through third-party suppliers such as airlines, hotels, tour operators, and other service providers. We do not own or control these suppliers and cannot guarantee their services, pricing, or availability.

2.2 eSIM Purchases:

We offer the direct purchase of eSIM products through our website. All eSIMs must be paid in full at the time of purchase.

3. Booking Process and Payment Terms

3.1 Supplier Bookings:

When booking travel services with suppliers, we will provide you with the supplier’s specific payment terms, policies, and conditions. You will be required to provide credit card details so that we may make payments on your behalf directly to the supplier. Due to regulatory requirements, we cannot charge our company card and then invoice you; payment must be made using your provided credit card details for each supplier booking.

3.2 Agency Fees:

We charge agency fees for our services. Unless otherwise agreed, 50% of our fee is due upfront, and the remaining 50% is due just before the commencement of your trip. Invoices for our agency fees will be emailed to you, and payments are processed via Square.

3.3 eSIM Purchases:

eSIM purchases must be paid in full at the time of order. eSIMs cannot be changed or canceled once activated. Refund requests must be made prior to installation and activation of the eSIM, and we will review such requests on a case-by-case basis.

4. Changes, Cancellations, and Refunds

4.1 Supplier Policies:

Each supplier maintains its own change, cancellation, and refund policies. We will provide you with these policies before finalizing any booking. By proceeding with a booking, you agree to abide by the supplier’s terms and conditions. If suppliers change their prices, availability, or terms, we are not liable for these fluctuations. We will inform you of any price increases or changes as soon as possible and will seek your authorization before finalizing altered arrangements.

4.2 Agency Fees:

Our agency fees are generally non-refundable. However, if you believe you have a legitimate reason for a refund, please contact us. Refunds will be determined on a case-by-case basis at our sole discretion.

4.3 eSIM Refunds:

Refunds for eSIMs are only possible if the eSIM has not yet been installed or activated. Please contact us promptly if you wish to request an eSIM refund. We will review such requests individually.

5. Pricing and Availability

5.1 Variable Pricing:

Travel prices and availability are subject to change without notice due to supplier policies, currency fluctuations, and other factors beyond our control. Any price quote provided is only valid at the time it is given and cannot be guaranteed beyond that point. We are not liable for any pricing changes that occur before your booking is confirmed.

5.2 Accuracy of Information:

While we strive for accuracy, we cannot guarantee that all information regarding travel options, supplier policies, and availability is free from error. In the event of discrepancies or changes, we will notify you and work with you to make adjustments.

6. Your Responsibilities and Conduct

By using our services, you agree to:

    •    Provide accurate, current, and complete information.

    •    Comply with all applicable local, provincial, and federal laws, as well as any supplier-specific rules and regulations.

    •    Not engage in unlawful, fraudulent, or abusive activities related to our services.

7. Intellectual Property

7.1 Ownership:

All content, branding, logos, graphics, text, and other materials on our website and communications are the property of Beach Bum Vacations unless otherwise noted. Such materials are protected by copyright, trademark, and other intellectual property laws.

7.2 Restrictions on Use:

You may not reproduce, distribute, modify, create derivative works from, or publicly display our content without our prior written consent, except for limited sharing on social media platforms.

8. Disclaimers and Limitations of Liability

8.1 Third-Party Suppliers:

We do not own or control third-party suppliers and cannot guarantee their performance. Your relationship with suppliers is subject to their terms and conditions. We act solely as an intermediary, and our liability is limited to the greatest extent permitted by applicable law and TICO regulations.

8.2 No Warranty:

We provide our services “as is” without warranties of any kind, express or implied. We are not responsible for delays, changes, or cancellations caused by suppliers or other factors beyond our control.

9. Dispute Resolution

9.1 Initial Resolution:

If you have a dispute with us, please contact us directly. We will work with you and, if needed, our host agency Nexion Canada to seek a resolution.

9.2 TICO Involvement:

If disputes cannot be resolved through direct communication and escalation to Nexion Canada, you may file a claim or dispute with TICO as governed by Ontario’s travel industry regulations.

10. Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices or for legal and regulatory reasons. The most current version will be posted on our website, and we will notify you by email if you have shared your personal information with us. Continued use of our services after any changes indicates your acceptance of the updated Terms.
